References to "Octopost," "we," "our," or "us" mean Octopost.ai and the Services we provide.

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. By using the Services, you represent that you meet these requirements.

To use certain features, you must create an account. You agree to provide accurate information, keep your credentials secure, maintain accurate workspace and billing details, and promptly notify us of unauthorized access.

You are responsible for all activity under your account, workspaces, API keys, OAuth clients, and connected social accounts, including actions taken by invited workspace members, authorized automations, or third-party OAuth clients you approve.

4.1 Permitted Use

You may use the Services to create, schedule, publish, review, automate, and analyze social media content through supported workflows.

4.2 Prohibited Use

You agree not to use the Services to:

• Violate any law, regulation, third-party right, or social platform policy
• Publish spam, scams, misleading content, malware, phishing, or abusive automation
• Impersonate others or misrepresent affiliation, authorization, identity, or ownership
• Upload or distribute unlawful, harmful, defamatory, obscene, infringing, or exploitative content
• Reverse-engineer, scrape, probe, overload, disrupt, or bypass security, rate limits, plan limits, or access controls
• Use the Services to build or operate systems that violate platform rules or our instructions

By connecting a social account, you authorize Octopost to access the permissions you approve through the relevant platform OAuth flow. These permissions may allow us to publish content, retrieve account metadata, sync analytics, refresh tokens, and support Facebook inbox features such as comments or direct messages where available.

You are responsible for complying with each connected platform's terms, policies, permissions, and content rules. Platform API changes, outages, reviews, permission limits, or enforcement actions may affect the Services.

You may revoke Octopost access through the relevant platform settings, but revocation may stop publishing, analytics, inbox, API, or automation features from working.

6.1 Your Ownership

You retain ownership of content you create, upload, import, schedule, or publish through the Services.

6.2 License to Operate the Services

You grant us a non-exclusive, worldwide, royalty-free license to host, process, store, transmit, display, adapt for technical formatting, and publish your content solely as needed to provide, secure, support, and improve the Services.

6.3 Your Responsibility

You are responsible for your content, including its legality, accuracy, permissions, intellectual property rights, privacy compliance, and compliance with connected platform rules. We are not responsible for content you publish through the Services.

The Services may include AI-assisted drafting, rewriting, caption generation, hashtag suggestions, planning support, and similar features powered by providers such as OpenAI and Anthropic.

AI outputs may be inaccurate, incomplete, offensive, or unsuitable for your use case. You are responsible for reviewing, editing, and approving AI-generated content before publishing. Do not submit sensitive personal data, confidential information, regulated data, or content you do not have permission to process through AI features.

Octopost provides a public API and OAuth authorization features for approved workflows. You are responsible for the applications, agents, scripts, automations, and OAuth clients you build or authorize.

API requests are currently limited to 60 requests per minute. We may change, reduce, increase, or enforce rate limits, quotas, scopes, and endpoint availability at any time to protect the Services or comply with platform requirements.

You must keep API keys, client secrets, OAuth tokens, and access credentials confidential. You must not expose them in public repositories, client-side code, logs, or other insecure locations.

Some features require a paid subscription. Octopost may offer a 14-day free trial. Unless you cancel before the trial ends, your subscription may automatically convert to a paid plan.

Subscriptions renew automatically on a monthly or yearly basis, depending on the plan you choose, until canceled. Billing is processed by Polar.

Fees are non-refundable except where required by law. If you cancel, your paid features remain available until the end of the current billing period, after which your access may be downgraded, limited, or disabled according to your plan.

You are responsible for taxes, payment method validity, failed payments, and keeping billing information current. We may suspend or limit paid features if payment fails.

Octopost owns the Services, software, design, interface, documentation, trademarks, branding, and other materials we provide, excluding your content and third-party materials. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Services except as expressly allowed by law or by written permission.

The Services are provided without any uptime commitment or service-level agreement. We do not guarantee uninterrupted access, error-free operation, continued feature availability, successful publishing, analytics completeness, inbox sync availability, or compatibility with third-party platforms.

We may change, suspend, restrict, or discontinue any part of the Services at any time.

The Services depend on third-party platforms and providers, including social platforms, Cloudflare R2, Brevo, Polar, OpenAI, Anthropic, Pusher, and other infrastructure or software providers. We are not responsible for third-party services, APIs, outages, pricing, policy changes, permissions, review processes, data practices, or enforcement actions.

We may suspend, limit, or terminate your account, workspace, API access, OAuth client, connected account workflow, or specific feature access if we believe you violated these Terms, abused the Services, created security risk, failed to pay, violated platform policies, used spam or harmful automation, or created legal, operational, or reputational risk.

You may stop using the Services at any time. Upon termination, your access is revoked and your data may be deleted according to our Privacy Policy.

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, and uninterrupted operation to the fullest extent permitted by law.

To the maximum extent permitted by law, Octopost is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, failed publishing, platform API issues, unauthorized access, or damages caused by third-party services.

Our total liability for all claims relating to the Services will not exceed the amount you paid to Octopost for the Services in the six months before the event giving rise to the claim.

You agree to indemnify and hold harmless Octopost from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use or misuse of the Services, your applications or automations, your violation of these Terms, your violation of law or platform policies, or your infringement of third-party rights.

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Some jurisdictions may provide mandatory consumer protections that cannot be waived by contract.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. If changes are material, we may provide additional notice where appropriate. Continued use of the Services after changes take effect means you accept the updated Terms.
